Terms of Use
Last updated: October 2026 · These terms govern bookings, inquiries and use of fantastictoursvi.com. Plain-English summaries appear in italics; the formal text controls.
1. About Fantastic Tours VI
Fantastic Tours VI (“we”, “us”) operates fantastictoursvi.com, a booking and inquiry platform for tours and excursions in the U.S. Virgin Islands and adjacent BVI waters, including the Fantastic VI Race, powerboat and catamaran charters, land tours, eco-adventures and cruise shore excursions. We coordinate, schedule and confirm these experiences through licensed, insured local operators (captains, drivers, guides and venues) who deliver the services.
In short: we plan your day and stand behind it; the boat, the jeep and the glow are operated by vetted island professionals.
2. Use of this website
You may use this site for lawful trip-planning and booking purposes. You agree not to: (a) submit false or another person’s information; (b) attempt to disrupt, overload or gain unauthorized access to the booking systems; (c) scrape, copy or republish our tour content, puzzle/clue materials, branding or the compass emblem without written permission; or (d) use the site to market competing tour services without a signed partnership agreement.
3. Inquiries, quotes and confirmed bookings
Forms and emails are inquiries, not contracts. A booking becomes a binding reservation when you accept our written confirmation email (which states vessel/vehicle, guide, hour-by-hour itinerary, price, pickup point and return target) and any required deposit is received. A 10% booking service fee is not charged to guests; operator and payment costs are included in quoted prices.
4. Deposits, balances and pricing
Shared tours require a 30% deposit to confirm; private charters require 50%; full-boat corporate charters may follow invoicing terms stated in the quote. Balances are due 48 hours before departure unless the quote says otherwise. Quoted prices are in USD, per person unless marked “private” or “per group”. Peak cruise season (Dec–Apr), public holidays and event days may carry surcharges disclosed at quoting.
5. Cancellations, weather & the ship-shape guarantee
Guest cancellations: free up to 72 hours before departure (shared tours) or 7 days (private charters); inside those windows deposits are non-refundable but apply to a future date within 12 months. Operator, weather or sea-state cancellations: full refund or free rebooking — our choice is always yours to pick. Cruise shore excursions guarantee a return target at least two hours before your ship’s scheduled sail-away; if a Fantastic Tours VI delay causes you to miss departure, we refund the tour in full and cover reasonable, documented onward travel costs to your next port.
6. Guest requirements & safety authority
You must disclose mobility, medical and swimming-ability factors that affect activity fit at booking. Captains and guides hold final authority over safety — life jackets, entry zones, wildlife distance, alcohol service and itinerary changes due to conditions. Refusing safety instructions may end participation without refund. Minimum ages apply to some activities (e.g., 6+ for night kayak). Passports are required for BVI crossings; visa/entry rules are the guest’s responsibility to verify.
7. Conduct, alcohol & charter rules
Fantastic Tours VI is a family-first platform. Harassment of crew, other guests or residents, drug use on vessels/vehicles, standing in moving vehicles, or damage to reef or historic sites results in immediate removal without refund. Alcohol is served only by licensed crew; BYO is welcome on charters when the skipper approves.
8. Photos, media & publicity
Photo/video coverage included with tours is delivered to you for personal use. By participating you grant us a non-exclusive license to use group/individual photos for marketing unless you tell us otherwise at check-in. Our proprietary race clue materials remain our intellectual property; reproduction of puzzles is prohibited.
9. Technology, payments & the Kline IT Solutions relationship
This site, the booking engine, payment processing and data infrastructure are provided by Kline IT Solutions, our parent technology company. Card data is processed only through their PCI-compliant payment links; no card numbers are stored on this site. Business/enterprise engagements with Kline IT Solutions (partner portals, custom software, managed IT) are governed by separate agreements, not by these consumer terms.
10. Third-party links
Links to partners such as Caribbean Zest and other sites are provided for convenience; we are not responsible for their content or policies.
11. Liability limits
To the maximum extent permitted by USVI law, our total liability for any claim relating to a tour is limited to the amount you paid for that tour, except for our gross negligence or willful misconduct. We are not liable for indirect losses (missed connections, shore-leave plans, emotional “I should’ve booked the catamaran” damages). Nothing in these terms limits statutory consumer rights or liability that cannot be excluded.
12. Governing law & disputes
These terms are governed by the laws of the U.S. Virgin Islands. Good-faith resolution first: email [email protected]; most disputes on this island end with an honest adjustment, we’d like yours to too. Courts of the Virgin Islands, St. Thomas Division, have exclusive venue.
13. Changes & contact
We update these terms when our services or the law change; material changes to booking rules are emailed to active guests. Questions: [email protected] — say “Terms” in the subject.
